Arka Majumdar shares his views with ETLegalWorld
Our Partner, Arka Majumdar, shared his insights with ETLegalWorld on why some of the most disruptive appeals in the insolvency process are often not driven by substantive legal issues. He explained that many challenges at the NCLAT level today are initiated by parties on the fringes of the insolvency process, primarily to stall an already-approved resolution rather than raise genuine legal concerns.
He highlighted the need for a leave-to-appeal filter and calibrated refundable deposits to deter delay-driven litigation without depriving bona fide appellants of access to justice.
