Arka Majumdar authors Financial Express Explainer on the Supreme Court’s ‘Industry’ Ruling
We are pleased to share that our Partner, Arka Majumdar, has authored an article for Financial Express (India) examining the Supreme Court’s recent nine-judge Bench ruling on the meaning of “industry” and the questions that remain open under India’s new labour law framework.
Arka examines how the Supreme Court’s ruling reaffirms the Bangalore Water Supply & Sewerage Board v. A. Rajappa test for determining what constitutes an “industry” in pending disputes under the Industrial Disputes Act, 1947. He also explains why the ruling does not conclusively settle the position under the Industrial Relations Code, 2020, and highlights the scope for future judicial interpretation of the term “industry” under Section 2(p) of the Code.
