Argus Partners successfully represented Standard Chartered Investment and Loans (India) Limited before the High Court of Judicature at Bombay in a significant arbitration matter concerning the validity of the sale of pledged securities under a loan-cum-pledge facility.
By its judgment dated September 9, 2026, the High Court dismissed the petition filed under Section 34 of the Arbitration and Conciliation Act, 1996, and upheld the arbitral tribunal's finding that the sale of the pledged shares was validly effected pursuant to the top-up notices issued for the margin shortfall, and rejecting the challenge to the award on grounds of perversity and patent illegality.
The judgment reaffirms the sanctity of arbitral awards and the limited scope of interference available under Section 34, while reinforcing the enforceability of contractual margin and top-up mechanisms in securities-backed lending arrangements.
