Udit shares his views with CNBC
Our Partner, Udit Mendiratta, shared his insights with CNBC on the scope of safe harbour protection available to social media platforms in India and the circumstances in which such immunity may be lost.
He highlighted that safe harbour protection grants conditional immunity to social media companies, which can be removed if a platform has abetted an unlawful action, failed to remove content “expeditiously” after a court or government order, or failed to meet its “due diligence obligations” in removing child sexual abuse material, deepfakes and hate speech.
Udit noted, “Under the existing Indian law, loss of immunity is content specific,” adding that the law would need to be amended to remove the safe harbour immunity of an entire platform.
