Report on Use of Technology in the Justice System
The Confederation of Indian Industries (CII) has recently published a comprehensive report on ‘Use of Technology in the Justice System’(“Report”). The Report explores the need and the manner in which technology can be infused in functioning of the Indian judicial system and consequent changes in existing laws that may be necessitated.
Argus Partners has been spearheading this initiative. The Report has been written by our team led by Krishnava Dutt, Maneesha Kongovi and Pooja Chakrabarti.
As we live in a world dominated by live streaming, smartphones and social networks, it is imperative that we exploit the technological advantage we have at our disposal in every field, including the justice system. In the wake of the COVID-19 pandemic, we have been compelled to explore innovative options, such as e-filing of pleadings before courts and conducting hearings before judges through video conferencing. There is no reason why we should not continue to use the benefits of technology in the same manner. The Report contains a brief overview of the technology used in certain other countries and certain other sectors in India, reviews existing use of technology in the Indian judicial system and ascertains the need to migrate to an online dispute resolution system. The Report also discusses how different stages of a civil trial may be partially migrated online and explores how online dispute resolution may be implemented.
As a Firm we do understand that all members of the legal fraternity may not have access to necessary technological tools for making this into an ubiquitous concept across the bar and the bench. The suggestions in this Report is NOT to replace the existing system but rather to supplement it where possible for a more efficacious administration of justice.
